Sexual Discrimination in the Workplace

Sexual discrimination in the workplace or gender discrimination in the workplace occurs when a man or woman is denied employment, job promotion, or is mistreated or unfairly treated in the workplace because of their gender. At the beginning, and during the interview process, if your prospective employer focuses exclusively on questions specific to your gender or what you are able to contribute to the company based on your gender, then you are already being discriminated against. In the same way, if you are employed but do not have the same opportunities for development at work as your co-workers because of your sex or gender, you can complain against your employer either within your grievance machine at work or with the appropriate government agency.

However, you should note that it is harder than it sounds to file a lawsuit and claim damages against your employer. Many workers make the error of attempting to settle cases of discrimination based on gender or allegations on their own. Seeking compensation against your employer on your own is ill-advised as he or she has the resources to hire defense attorneys who are more informed about the law on gender discrimination to challenge your claim.
